Terms of Service
These Terms of Service (hereinafter referred to as "the Terms") set forth the terms and conditions for the use of all products and services (hereinafter referred to as "the Services") provided by RAVI SYSTEMS CORP. (hereinafter referred to as "the Company"). By using the Services, you agree to these Terms.
1. Application
The purpose of these Terms is to define the rights and obligations between the Company and the customer regarding the use of the Services, and these Terms shall apply to all relationships related to the use of the Services between the customer and the Company.
2. User Registration
Those who wish to use the Services shall apply for user registration in accordance with the method prescribed by the Company. The Company may not approve the application for user registration if it determines that the applicant has any of the following reasons:
- The applicant has provided false information
- The applicant has violated these Terms in the past
- The Company otherwise deems the application inappropriate
3. Management of User ID and Password
Customers shall properly manage their user ID and password for the Services at their own responsibility.
4. Prohibited Matters
In using the Services, customers must not engage in the following acts:
- Acts that violate laws or public order and morals
- Acts related to criminal activity
- Acts that infringe intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other users of the Services, or third parties
- Acts that may interfere with the operation of the Services
- Unauthorized access or attempts to gain unauthorized access
- Acts of collecting or accumulating personal information about other users
- Other acts that the Company deems inappropriate
5. Suspension of Service Provision
The Company may suspend or interrupt the provision of all or part of the Services without prior notice to customers if it determines that any of the following reasons exist:
- To perform maintenance or updates of the computer systems related to the Services
- When the provision of the Services becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- When computers or communication lines are stopped due to accidents
- Other cases where the Company determines that the provision of the Services is difficult
6. Restriction of Use and Cancellation of Registration
The Company may, without prior notice to the customer, restrict the customer from using all or part of the Services, or cancel the customer's registration, if the customer falls under any of the following:
- Violation of any provision of these Terms
- False facts are found in the registered information
- Failure to pay debts such as fees
- No response to communications from the Company for a certain period
- Other cases where the Company deems the use of the Services inappropriate
7. Disclaimer of Warranty and Disclaimer
The Company does not expressly or impliedly warrant that the Services are free from defects (including, but not limited to, defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, or infringement of rights). The Company shall not be liable for any damages incurred by customers as a result of the Services.
8. Changes to Service Content, etc.
The Company may change the content of the Services or discontinue the provision of the Services without notice to the customer, and the Company shall not be liable for any damages incurred by the customer as a result.
9. Changes to Terms of Service
The Company may change these Terms at any time without notice to the customer. If the customer uses the Services after the change, the customer shall be deemed to have agreed to the changed Terms.
10. Handling of Personal Information
The Company shall handle personal information acquired through the use of the Services in accordance with the Company's Privacy Policy.
11. Notifications or Communications
Notifications or communications between the customer and the Company shall be made in accordance with the method prescribed by the Company.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall be the exclusive agreement jurisdictional court of first instance for any disputes arising out of or in connection with these Terms.
